Because the roof is generally considered common property, the strata corporation is legally obligated to repair and maintain it to a standard that protects the building’s integrity and safety.
Key legal duties include:
- Mandatory Maintenance (Section 72): The Act creates a non-delegable duty for the strata corporation to repair and maintain all common property, including the roof and structural components of the building envelope. This maintenance must keep the roof in a condition appropriate for the building’s age.
- Depreciation Reports: Stratas with five or more units must obtain a depreciation report every three years (unless waived by a 3/4 vote). This report must include a physical condition assessment of the roofing materials, drainage, and membrane integrity to forecast future replacement needs.
- Compliance with Building Codes: When replacing or significantly repairing a roof, the corporation must comply with current regulations, such as the upcoming 2026 BC Building Code thermal standards, which will require higher insulation R-values (R-40).
- Emergency Repairs: The council is authorized—and often compelled—to take immediate action to address leaks or damage that pose a danger or could lead to significant property damage, even without a formal vote in certain urgent cases.
- Financial Responsibility: The council must ensure maintenance is properly funded through the operating budget or the Contingency Reserve Fund (CRF) to avoid the need for sudden special levies. Deferring essential repairs can lead to legal liability, orders from the Civil Resolution Tribunal, and the potential voiding of manufacturer warranties.
